Terms of Use
These Terms of Use govern your access to and use of ApplyOrSkip and any related services, features, content, and applications we provide (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
2. Description of Service
ApplyOrSkip is a decision-support tool that analyzes resume and job description content and provides AI-generated outputs, including a recommendation such as Apply, Tailor & Apply, Borderline, or Skip, along with reasoning and suggested next steps. The Service is intended to help you decide whether a role is worth your time and tailoring effort.
You acknowledge that the Service provides automated suggestions only and does not make employment decisions on your behalf.
3. No Professional Advice
The Service is provided for informational and decision-support purposes only. It does not constitute legal, financial, career, or professional advice. You are solely responsible for your own application, career, and employment decisions.
4. Accounts and Access
You may be required to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and complete information and to keep it updated.
5. Subscriptions, Billing, and Cancellation
Some features of the Service may require a paid subscription.
If you purchase a subscription:
- You authorize us and our payment processors to charge your selected payment method for the applicable subscription fees and taxes.
- Subscription fees are billed in advance on a recurring basis, unless otherwise stated at the time of purchase.
- Your subscription will automatically renew at the end of each billing period unless you cancel before renewal.
- You may cancel your subscription at any time through your account settings or by contacting us.
- Cancellation will take effect at the end of the current billing period unless otherwise required by law.
- Except where required by law or expressly stated otherwise, subscription fees are non-refundable.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Upload or process content you do not have the right to use.
- Attempt to reverse engineer, copy, scrape, or interfere with the Service.
- Access or attempt to access accounts, systems, or data that you are not authorized to access.
- Use the Service in a manner that could damage, disable, or impair the Service or another user's experience.
We may suspend or terminate access if we reasonably believe you have violated these Terms or used the Service in a harmful, abusive, or unauthorized manner.
7. User Content
You retain ownership of the content you upload or submit to the Service, including resumes, job descriptions, and related materials (“User Content”).
By submitting User Content to the Service, you grant us a limited, non-exclusive, worldwide license to process, store, transmit, and display that content solely as necessary to provide, maintain, secure, and improve the Service, and to comply with legal obligations.
You represent and warrant that:
- You have the necessary rights to submit the User Content.
- Your User Content does not infringe any third-party rights, including intellectual property, privacy, or publicity rights.
- Your User Content does not violate any law or regulation.
8. AI-Generated Outputs
The Service uses automated systems to generate analysis, recommendations, and related content. AI-generated outputs may be incomplete, inaccurate, outdated, or unsuitable for your specific circumstances.
You acknowledge that AI-generated outputs should be reviewed carefully and that you remain responsible for evaluating and using them appropriately.
9. Service Availability
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. The Service is provided on an “as is” and “as available” basis.
We do not guarantee uninterrupted, secure, or error-free operation of the Service.
10. Intellectual Property
We and our licensors own all rights, title, and interest in and to the Service, including its software, design, branding, text, graphics, and other content, excluding User Content.
You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted by us in writing.
11. Third-Party Services
The Service may rely on third-party service providers to support functionality such as authentication, hosting, storage, analytics, payment processing, and AI-assisted analysis. Your use of third-party services may be subject to those third parties' terms and policies.
We are not responsible for third-party services outside our reasonable control.
12. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time if:
- You violate these Terms.
- We believe your use of the Service creates legal, security, or operational risk.
- We are required to do so by law.
You may request account deletion by contacting us.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will produce any particular outcome, including interviews, job offers, or employment opportunities.
15. Limitation of Liability
To the fullest extent permitted by law, ApplyOrSkip and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the Service.
Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the 12 months preceding the event giving rise to the claim, or the minimum amount permitted by law, whichever is greater.
16. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will post the updated Terms with a new effective date. Your continued use of the Service after the effective date means you accept the updated Terms.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of Hong Kong SAR, without reference to conflict of law rules. Any dispute arising out of or relating to these Terms or the Service is subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
